General Terms and Conditions for Events

1.1 These General Terms and Conditions (hereinafter ‘GTC’) of the Association of University Professors of Business Administration e.V. (hereinafter ‘VHB’) apply to all contracts for participation in events (hereinafter ‘event’) that a consumer (hereinafter ‘participant’) concludes with the VHB with regard to the events presented on the VHB website.

1.2 The events of the VHB are designed for academics in business administration and can be booked by interested parties from this field at corresponding nominal fees (‘participation fee’) unless they are offered free of charge.


2.1 The VHB offers online, hybrid and face-to-face courses.

2.2 The content of the event is set out in the respective event description and, where applicable, the syllabus on the VHB website.

2.3 VHB provides its services with the utmost care and to the best of its knowledge and belief by qualified personnel selected by it.


3.1 The events described on the VHB website do not constitute binding offers on the part of the VHB, but are intended for the submission of a binding offer by the participant.

3.2 The Participant can submit his/her offer by registering to take part in the event in writing, e.g. via the online registration form on the VHB website or by email, thereby submitting a legally binding contractual offer in relation to the selected event.

3.3 The contract for participation in the event is only concluded upon written confirmation of registration or request for payment from VHB, e.g. by email (conclusion of contract).

3.4 Registration for chargeable events is only finalised once payment has been received in full. Prior to this, your place is merely reserved. Bookings that are not paid for on time can be cancelled by the VHB. You will receive an e-mail once payment has been successfully received.


4.1 Consumers are generally entitled to a right of cancellation, whereby a consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity.

Right of cancellation:
You have the right to cancel the contract declaration in text form (e.g. e-mail) within fourteen days from the date of conclusion of the contract without giving reasons. Timely dispatch of the cancellation is sufficient to comply with the cancellation period. The cancellation period ends prematurely if the participant takes part in the booked event before the end of the cancellation period.

Consequences of cancellation:
In the event of an effective cancellation, the services received by both parties must be returned. If the participant is unable to return the goods or services received in full or in part, he/she must compensate VHB for the loss in value. The obligation to reimburse payments must be fulfilled within 30 days. The period begins for the participant when the cancellation notice is sent and for VHB when it is received.

4.2 The right of cancellation expires prematurely if VHB begins to provide the service with the express consent of the participant before the end of the cancellation period or if the participant arranges for the service to be provided himself (e.g. the participant takes part in the event).


5.1 The participation fee stated in the event announcement is the final price, is binding on the participant and, where applicable, includes the VAT due.

5.2 The participation fee is per person and event. Participation is only possible for the entire event. A reduction of the participation fee due to shortened participation is not possible.

5.3 Accommodation, travel, catering and other costs are not included in the participation fee and must be borne by the participant, unless otherwise agreed.


6.1 The payment options are communicated to the participant on the VHB website.

6.2 Unless expressly agreed otherwise, the participation fee shall be due for payment without deduction immediately upon conclusion of the contract and at the latest upon receipt of the invoice, unless the parties have agreed a later due date.

6.3 The participant must pay the contractually agreed participation fee in full, even if the event is missed for whatever reason.


7.1 Irrespective of any existing statutory right of cancellation, VHB grants the participant the right to cancel his/her registration for a VHB event (contractual right of cancellation). Cancellation of the registration by the participant is only possible in writing (e.g. e-mail).

7.2 For chargeable events (without course preparation tasks)

cancellation is possible up to four weeks before the start of the event. In this case, the VHB will charge a processing fee of 25 euros.

For cancellations up to two weeks before the start of the event, 50% of the course fee is due.

Thereafter or in the event of non-appearance of the participant, the entire participation fee will be charged.

7.3 If a course preparation task is planned for the event,

cancellation is possible up to two weeks before the date specified in the syllabus for the course preparation assignment. In this case, the VHB will charge a processing fee of 25 euros.

Thereafter, cancellation is possible up to four weeks before the start of the course; the processing fee then amounts to 50% of the course fee.

Thereafter, or in the event of non-appearance of the participant, the entire participation fee will be charged.

7.4 If the event is offered free of charge, participation can be cancelled free of charge at any time. Please inform us accordingly.

7.5 Only the registered participant is entitled to participate. A transfer of the contract to a third party is only possible with the consent of VHB.

7.6 If a third party enters into the contract between the participant and the VHB, the third party and the participant shall be jointly and severally liable to the VHB for the participation fee.


8.1 The VHB is entitled to cancel the event at short notice for important reasons, such as force majeure, illness of a speaker or due to an insufficient number of participants. In this case, the participants will be informed immediately. The VHB will endeavour to find an alternative date if the event is cancelled.

8.2 If the event is cancelled, VHB shall refund any participation fees already paid in full. No further claims can be made against VHB.


9.1 The copyright to lectures and event documents of any kind belongs solely to VHB or, if indicated accordingly, to the respective author or publisher. The participant is not permitted to reproduce the lectures or event documents in whole or in part, to record them in data-processing media, to distribute them in any form and/or to make them accessible to third parties without the written consent of VHB.

9.2 Audio and video recordings and descriptions of the event, the event results in whole or in part are not permitted.
 


10.1 VHB accepts no liability for the intended success of the event. In particular, the VHB does not guarantee that the participant will achieve a specific learning outcome or reach a specific performance target.

10.2 The format of VHB ProDok events is regularly designed in such a way that the workload is equivalent to the number of LP/ECTS (European Credit Transfer and Accumulation System) credits shown in the syllabus. Successful participation is certified in the form of a certificate of achievement. Recognition at the respective university must be clarified individually by the participant.

10.3 Claims for damages against both VHB and its vicarious agents are excluded for damage suffered by the participant in the event rooms (hotel, conference venue, etc.), unless caused by wilful intent or gross negligence.

10.4 The VHB is not liable for items brought in by the service user (cloakroom, training material, valuables, etc.). The respective house rules must be observed.

10.5 Furthermore, VHB and its vicarious agents shall not be liable for disruptions of any kind caused by circumstances beyond their control.

10.6 Liability for damage caused during travel to and from the event venues, as well as for losses and accidents, is excluded to the extent permitted by law.


11.1 VHB collects, processes and uses the participant's data for the purpose of fulfilling the contractual relationship. The legal basis for data processing is Art. 6 para. 1 GDPR.

11.2 In addition, the following data will be passed on to speakers, other participants and, if necessary, to local organisers First name, surname, institution, email address. The participant may object to this disclosure at any time.

11.3 The participant agrees that the events may be documented in whole or in part in image and sound for the purposes of quality assurance and reporting or other association-related purposes. The participant may revoke this consent at any time.

11.4 Any further processing and utilisation of data shall only take place if the participant has consented to this.


12.1 The law of the Federal Republic of Germany shall apply to all legal relationships between the parties. The place of jurisdiction is Göttingen.

12.2 Should individual provisions of this contract be invalid or lose their validity due to a circumstance occurring at a later date, the validity of the remainder of the contract shall remain unaffected. The invalid contractual provisions shall be replaced by a provision that comes closest to what the contracting parties would have wanted if they had considered the point in question. The same applies to loopholes in this contract.
